The shooting death of a 2-month-old girl in Lancaster County, has been ruled a homicide.  The coroner conducted an autopsy on Thursday.  But this ruling doesn’t necessarily mean it was criminal.  Police are still investigating to try to find out exactly what happened.

Two-month-old Kestyn Davis was shot in the abdomen and killed by a family member on Christmas Eve.  It happened around 2:30 p.m. at a home in the 2100 block of Old Philadelphia Pike in East Lampeter Township.

“It’s just unreal.  They are such nice people and I know it was an accident.  But still I feel for both of them and I don’t judge either one of them.”  It was a scene still very fresh Carl Kutzer’s mind. He lives next door to where this happened.  He saw police carry the baby out.

“Just total shock,” said Kutzer.  “It just hit me to the core.  It’s really terrible.  I was visibly shaking.”

District Attorney Craig Stedman stressed responsible gun ownership when he addressed the media the night it happened.  He said they know who had the hand gun when it went off, but no one has been arrested or charged.

Stedman said the investigation will take some time. Forensics, ballistics and witness interviews will tell the story.

“We’re going to follow the facts and get to the truth of it and make the appropriate decision and the appropriate time,” said Stedman.

Stedman said he expects to have the investigation wrapped up by early next week. At that point, he will decide if charges will be filed.
