A jury is debating the fate of a York County man accused of killing his neighbor.
Police say the two men had a history of arguing.
The jury began deliberations Friday afternoon after a week long trial, with District Attorney Tom Kearney himself prosecuting it.
It’s now up to jurors to determine if Spencer Newcomer should be found guilty of criminal homicide for David Wintermyer’s death.
Newcomer shot the 47-year-old in June of 2012. He has claimed it was in self defense. The neighbors had a history of arguing.
Newcomer says he fired his gun when Wintermyer reached into a pocket and he believed he was getting a gun. It turned out to be a cell phone.
Prosecutors have argued that self-defense is not an excuse for shooting someone four times, including once in the back.
Again Newcomer’s fate is now in the hands of jurors.
